These Terms of Service (“Terms”) govern your use of swanbotanicals.com and the purchase of products from Swan Botanicals, owned and operated by Eshwar Karthikeya Organics Private Limited (“Company”, “we”, “us”, “our”). By accessing the Website or placing an order, you agree to these Terms, our Privacy Policy, Return & Refund Policy and Shipping Policy. If you do not agree, please do not use the Website.
1. Eligibility
You must be at least 18 years old and capable of entering into a legally binding contract under the Indian Contract Act, 1872. By ordering, you confirm you meet these requirements.
2. Account
You are responsible for the confidentiality of your account credentials and all activity under your account. Please provide accurate, current and complete information.
3. Products, Descriptions & Availability
Our products are natural and botanical-based personal-care and cosmetic products. We try to display colours, packaging and descriptions accurately; actual shade, fragrance and texture may vary slightly due to natural ingredients and your device's display. All products are subject to availability, and we may limit quantities or discontinue any product at any time.
4. Pricing, Taxes & Payment
- All prices are in Indian Rupees (INR) and inclusive of applicable GST unless stated otherwise.
- We may correct pricing errors and change prices at any time without prior notice.
- Payment must be made through the methods offered at checkout. Orders are processed only after successful payment authorisation (or, for COD, on order confirmation).
5. Orders & Acceptance
Your order is an offer to purchase, subject to our acceptance. We may refuse or cancel any order, including for suspected fraud, pricing errors, stock unavailability or non-serviceable delivery. Where payment was made for a cancelled order, it will be refunded.
6. Intellectual Property
All content on the Website, including the “Swan Botanicals” and “GLOHA” names, logos, trademarks, formulations, images, text and design, belongs to the Company or its licensors and is protected by applicable laws. You may not copy, reproduce or use it without our prior written permission.
7. Acceptable Use
You agree not to use the Website for any unlawful purpose, to infringe rights, to introduce malicious code, to scrape or copy data, or to interfere with its operation.
8. Product Use & No Medical Claims
Our products are cosmetics for external use only, used as directed on the packaging. They are not medicines and are not intended to diagnose, treat, cure or prevent any disease or condition. We recommend a patch test before first use. Results may vary. If you have a known allergy, skin/scalp condition, or are pregnant or nursing, consult a qualified medical practitioner before use.
9. Limitation of Liability
To the maximum extent permitted by law, the Company is not liable for any indirect, incidental, special or consequential damages arising from use of the Website or products. Our total liability for any claim shall not exceed the amount you paid for the product giving rise to the claim. Nothing here limits liability that cannot be excluded under the Consumer Protection Act, 2019 or other applicable law.
10. Indemnity
You agree to indemnify and hold harmless the Company, its directors, employees and agents from any claims, losses or expenses arising from your breach of these Terms or misuse of the Website or products.
11. Force Majeure
We are not liable for failure or delay caused by events beyond our reasonable control, including natural disasters, strikes, pandemics, government action, or failures of logistics or communication networks.
12. Governing Law & Jurisdiction
These Terms are governed by the laws of India. Subject to the dispute-resolution clause below, the courts at Guntur, Andhra Pradesh have exclusive jurisdiction.
13. Dispute Resolution
The parties shall first attempt to resolve any dispute amicably. Failing resolution within 30 days, it may be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996, seated at Guntur, Andhra Pradesh, in English. This does not affect your rights as a consumer under the Consumer Protection Act, 2019.
14. Changes to These Terms
We may revise these Terms at any time; the updated version is effective when posted. Continued use of the Website means you accept the revised Terms.
